Terms and Conditions and Cancellation Policy for Retreat Participants for:

"In the hands of Parvati Mā"

Retreat Dates: 26 June 2027 – 3 July 2027
Location: Las Mecias, Alpujarras, Spain

 

1. Introduction

These Terms and Conditions (“Terms”) govern the agreement between you (“the Participant”) and ”Mmm Yoga” (“we,” “us,” or “the Organiser”), concerning your participation in our accommodation, retreats, workshops, or other events (collectively, the “Retreat”) located in Spain. By booking with us, you confirm that you have read, understood, and agreed to these Terms.

 

2. Booking and Payment

  • A booking is considered confirmed only upon receipt of a deposit or full payment as specified at the time of booking.

  • Payments may be made via bank transfer, credit card, or other accepted methods.

  • The full balance is due no later than 60 days before the start of the Retreat unless otherwise agreed in writing.

 

3. Booking Confirmation and Deposit

  • A non-refundable deposit of £400 is required to secure your place on the retreat.

  • The deposit confirms your booking and covers upfront costs such as venue hire, planning, and administrative fees.

  • Final payment of the remaining balance is due by 26 April 2027. Failure to pay by this date may result in the loss of your spot.

 

4. Cancellation Policy

BY THE PARTICIPANT:

Cancellations must be made in writing via email. The following cancellation fees apply:

  • 90+ days before the retreat start date (on or before 26 March 2027):

    • You will lose your deposit (£400) but will not be liable for the remaining retreat cost.

  • Less than 60 days before the retreat start date (after 26 April 2027):

    • You will lose your deposit (£400) and 50% of the remaining retreat cost.

  • Less than 30 days before the event: No refund.

If a replacement participant is found for your booking, we may offer a partial or full refund at our discretion.

Travel insurance covering cancellation is strongly recommended.

  • Early Departure:

    • If you leave the retreat early for any reason, no refunds will be issued.

  • Transferring Your Spot:

    • You may transfer your reservation to another person, provided they meet the retreat’s requirements and complete the registration process. The new participant must be approved by the retreat Organiser.

    • Transfer requests must be submitted in writing at least 30 days before the retreat start date.

 

BY THE ORGANISER:

We reserve the right to cancel the Event due to unforeseen circumstances, including but not limited to insufficient participants, instructor illness, or force majeure (e.g. natural disasters, pandemics, government restrictions).

  • In such cases, we will offer:

    • A full refund, or

    • Transfer of your booking to a future date or similar event (subject to availability)

  • We are not responsible for any other costs incurred, such as flights or travel expenses.

 

5. Changes to the Program

While we strive to deliver the retreat as advertised, minor changes (e.g. yoga teacher, class times, day trip out) may occur. If a significant change is necessary, you will be notified as soon as possible. In such cases, you may choose to:

  • Receive a full refund.

  • Transfer your payment to a future retreat.

 

6. Participant Conduct

By attending the Retreat, you agree to:

  • Respect all local laws and customs in Spain.

  • Refrain from any disruptive, abusive, or unsafe behaviour.

  • Follow instructions given by staff, facilitators, or venue management.

  • Use the facilities respectfully, leaving shared areas clean and undamaged.

We reserve the right to remove any participant who violates these guidelines without refund

 

7. Health, Safety & Medical Conditions

  • Participants must inform us in advance of any medical, physical, or mental conditions that may affect participation.

  • You participate voluntarily and assume all risks associated with activities during the Retreat.

  • We reserve the right to decline participation in specific activities based on health/safety considerations.

  • All participants are required to take full personal responsibility for their own health, safety, and wellbeing during the Retreat.

  • You acknowledge that participation in physical, emotional, or spiritual activities (including but not limited to yoga, movement, hiking, breathwork, or meditation) involves inherent risks. You participate voluntarily and at your own risk.

  • You are expected to act sensibly, listen to your body, and make decisions appropriate to your own abilities and limitations.

  • You agree to inform the Organiser prior to the Retreat of any physical or mental health conditions, injuries, medications, allergies, or other relevant medical information.

  • We reserve the right to deny participation in certain activities if we believe it may compromise your safety or the safety of others.

IMPORTANT DISCLAIMER:

We are not medical professionals and do not provide medical advice. The retreat or workshop is not a substitute for professional healthcare, therapy, or treatment. Any physical, mental, or emotional practices offered are optional and undertaken at your own discretion.

We accept no liability for any injury, accident, or harm that may occur during your stay or participation, unless caused by proven negligence on our part.

 

8. Travel Insurance

  • Travel insurance is mandatory for all participants. It should cover:

    • Medical emergencies.

    • (Medical insurance valid in Spain is strongly recommended.)

    • Trip cancellations or interruptions.

    • Personal belongings.

    • Baggage loss

    • Personal liability

9. Travel

You are responsible for arranging your own travel to Malaga Airport and back home from Malaga Airport including passports and visas (if applicable).

 

10. Use of Images

During the Retreat, we may take photos or videos for promotional purposes. By attending, you grant permission for your image to be used unless you inform us in writing before the Retreat.

 

11. Liability Waiver

To the fullest extent permitted by law:

  • The Organiser shall not be liable for any injury, loss, damage, accident, delay, or expense resulting from your participation.

  • The Organiser is not liable for any accidents, illnesses, injuries or losses resulting from your own actions, choices, or pre-existing conditions.

  • You agree that your participation is entirely at your own risk and acknowledge that yoga and other activities involve physical exertion and may carry risks of injury. It is your responsibility to assess your own physical and mental capabilities before and during the Retreat.

  • You release and discharge Mmm Yoga, its owners, staff, facilitators, and partners from any and all liability for injuries (including physical, psychological, or emotional), loss, or damages you may suffer as a result of participation in any aspect of the Retreat, except in cases of gross negligence or willful misconduct.

  • You agree to assume all risks associated with your participation.

  • The Organiser makes no guarantees, representations or warranties of any kind, express or implied, with respect to the Retreat services agreed upon. In no event shall the Organiser be liable to the Participant for any indirect, consequential or special damages.  The Organiser's entire liability under this Agreement shall be limited to the amount actually paid under the Agreement.   

 

12. Dispute Resolution

  • Any disputes or concerns regarding cancellations or refunds will be addressed on a case-by-case basis. Please contact Mmm Yoga to discuss.

 

13. Data Protection (GDPR Compliance)

We comply with the UK's General Data Protection Regulation (GDPR). Any personal data you provide will be handled securely and only used for purposes related to the Retreat. We do not share your data with third parties without consent.

14. Governing Law & Jurisdiction

These Terms are governed by the laws of the United Kingdom, including (but not limited to) the Consumer Rights Act 2015. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of UK law. 

 

15. Force Majeure

We shall not be liable for any failure to perform due to causes beyond our reasonable control, including but not limited to acts of God, war, terrorism, labor strikes, pandemics, or government restrictions.
